This is arguably the most emotion-filled phrase spoken in business – perhaps rivaled only by its polar opposite fraternal twin, “You’re hired.” Rarely is the first phrase easy for an employer to say, even when it is justified. And even more rarely is that phrase easy for an employee to hear.
Obviously there is much more to employment law than hiring and firing. But those two acts – at the heart of much employment law, are the reason that it is one of the most emotionally volatile areas within the practice of law; which makes employment law one of the most delicate matters a lawyer can handle.
Our employment lawyers at Foltz Martin are well aware of all of these things, so we view our primarily role as counselors first, and often advise our clients on the proper handling of tricky or complex employee relations matters before they become problems. We approach employee problems with creative solutions and implementation of sound employment practices that enable our clients to avoid problems.
Our attorneys represent employers, small companies - including sole proprietorships, and large publicly and privately held corporations.
Litigation is (of course) an expensive way to solve employee problems, and sometimes jury trials can damage an employer in the eyes of the public even if the company is not at fault and the results of a trial confirms that fact. But there are times when litigation cannot be avoided, so in such cases we deliver cost-effective defense of claims in a vast array of matters including employment rights violations (Title VII, ADA, ADEA, FMLA, etc.) and wrongful discharge claims. We trust that if a representative of one of our clients says to an employee, “You’re fired,” that he or she has a sound and defensible reason for uttering that phrase. And our clients trust Foltz Martin employment lawyers to come to their defense, with swift, effective, creative, and cost conscious legal services and advice.
