Megan A. Kelly

“When I was a kid I wanted to be a private investigator, so one of the things that I most enjoy about litigation is doing the investigation - the discovery - finding the little details that just may change everything.”

Ms. Kelly has represented clients in a variety of complex and commercial cases including construction disputes, business torts, contract disputes, trade secret matters, products liability, officer and director liability and class actions.  Megan also litigates employment, civil rights and public accommodations claims.  She has defended numerous class actions including products liability and employment claims and collective actions under the Fair Labor Standards Act.  She has jury and non-jury trial experience in both federal and state courts, representing companies and individuals in civil litigation matters.

Representative Case History (Partial)

  • Successfully defended nationwide financial services provider against appeal of summary judgment obtained on negligence, fraud and breach of contract claims.
  • Obtained dismissal of eight plaintiffs' race discrimination public accommodations claims at summary judgment and award of costs.
  • Extensive experience in defending employers in collective and class litigation regarding misclassification claims under federal and state wage and hour laws
  • Represented national credit reporting agency against lawsuits by consumers filed under Fair Credit Reporting Act.
  • Successfully defended numerous product liability class actions on behalf of automobile manufacturer.
  • Represented clothing retailer in federal jury trial brought by customer asserting false imprisonment claim.
  • Negotiated numerous multinational strategic research and development, license, and distribution agreements in pharmaceutical and biologics industries.

With her business background and previous in-house experience, Megan brings a unique perspective when representing her clients.  Her first-hand experience as an Operations Manager and Human Resources Specialist for a major U.S. retailer and her former position as in-house counsel make her particularly attuned to the practical implications of litigation for a client's business and enhance her client-focused, cost-conscious approach to her practice.

Ms. Kelly received her undergraduate degree from Cornell University and later earned her law degree from University of Florida College of Law, where she was a member of the Florida Law Review and graduated with High Honors.  Upon completing law school, Megan served as a judicial law clerk for the Honorable Emmett Ripley Cox, United States Court of Appeals for the Eleventh Circuit.
