Construction Law: Litigation, Arbitration and General Counsel

“It’s gonna’ be twenty-six stories, mixed use with retail space on the street level, a five star hotel, private residences, and a world class restaurant on top. We’d like to talk to you about building it for us.”

“Well, I’d like to talk to you about that too.”

At Foltz Martin we understand the potent entrepreneurial passion that runs though the veins of developers and general contractors.

Our construction law group represents general contractors, owners, developers, and some large specialty contractors in complex commercial construction projects. Our attorneys have extensive experience in every aspect of construction law, working with issues ranging from day to day operations, to drafting and negotiating revisions to the standard AIA contracts, to providing dispute resolution in any format.

Atlanta Georgia construction law has been our primary focus, but we have represented developers, owners and GCs with commercial construction projects large and small all over the Southeast.

In Atlanta and in cites across the nation, our clients are the principal sculptors of the environments in which we live. Our clients change the landscapes of cites, towns, rural areas and the transportation routes that link them. With sleek glass, steel, concrete and stone mountains, our clients add beauty to our skylines, increase commerce, and provide places for our citizens to live and work. The work is performed safely, on tight budgets, under strict timelines and often in inclement weather.

When it becomes necessary to resolve disputes, our primary focus is to craft resolutions that are swift and economically efficient. We believe clients are entitled to evaluate the handling of matters and obtain more effective solutions. We seek to answer the question of “Why was that necessary?” by reviewing options in advance and relying on our years of experience in crafting creative and economical solutions to complex problems. The goal is to create a win/win scenario that resolves the dispute and preserves the relationship. Every dispute does not have to end bitterly. In most cases, the parties chose to work together in the first place for sound business reasons. Why destroy that relationship if savvy negotiating can save it?

There are few areas of the law that are as complex as construction law, so our construction lawyers have a wide breadth of knowledge that includes a solid understanding of risk management, engineering, erosion control, forensic accounting risks of green construction, construction defects, delay claims analysis, mold claims, water runoff claims and water intrusion claims. When it comes to Atlanta Georgia Construction law, from holes dug to bedrock, to towers of light dozens of stories high that can be viewed from beyond our state, our lawyers understand every aspect of what it takes to create architectural marvels as well as simple utilitarian structures.

We understand the spirit of pride that washes over a general contractor’s or developer’s face when he looks at the results of a good day’s work or a project completed. And we hear the unmistakable satisfaction in our client’s voices when we hear them say:

“We built that.”
