Trademarks and Copyright

Just seeing the logo makes you think, “Ahhhh, I have to have that soda.”

Just hearing three notes and you break into a duet with your favorite singer.

That’s the value of a trademark. And that’s why songs are copyrighted. Trademarks identify unique products in the marketplace and prevent counterfeiters from trading off another’s goodwill. Copyrights protect creative expression in all its many forms preserving the value of artists’ work.

In many ways, intellectual property is much easier to steal than “real” property. You can’t put a lock on a trademark or put a copyrighted work in a safe if you intend to make money on it. You have to toss both into the marketplace for many, any, and all to see, read, hear – and potentially steal. The realities of a global economy and the ease of pilfering created by digital video and audio recording devices, cameras, scanners, computers, and most especially the internet, have made protecting intellectual property more difficult than ever.

That’s why it’s important to retain the best possible legal representation to protect, defend, and manage your intellectual property. At Foltz Martin, we provide world-class protection, and - in accordance with applicable trade agreements and international laws, global coverage.

Our trademark and copyright lawyers play the dual roles of armed guard
– doing all within the law to protect your property from theft and unauthorized use, and we are also the cops – going after anyone who attempts to use your work without permission or compensation.

Our attorneys have the expertise to advise clients of the best ways to create, maintain and protect valuable intellectual property.

We assist our clients in securing trademark or copyright protection and domain names, protecting trade secrets through the use of employment or independent contractor agreements, and negotiating and drafting license agreements. Our attorneys also have experience and expertise litigating intellectual property rights in both the state and federal courts and in the Patent and Trademark Office. We recognize the importance of understanding a client's business and technologies and, with that understanding, help guide our clients through the complexities of today's intellectual property environment.

No matter how small your creation or company starts out, a trademark can be an extremely valuable thing that is worth protecting. After all, we live in a world where having an “apple” on your desk doesn’t mean that there is a snack within your reach and “mountain dew” is not just something that makes your boots wet when you hike on the Appalachian Trail.
